Gutierrez's attorneys argue that no physical or forensic evidence connects him to the crime, and have requested the U.S. Supreme Court to halt the execution.

Prosecutors claim Gutierrez was involved in a robbery to steal money hidden by Harrison.

Despite previous denials for DNA testing, Gutierrez maintains his innocence.

The case has similarities to another Texas death row inmate, Rodney Reed, who is also seeking DNA testing.

This would be the third execution in Texas this year.

Brian Steven Smith, a man convicted of killing two Alaska Native women, was sentenced to 226 years in prison.
